1. Agreement to Terms

By accessing and using the Thrive Tutors website, services or resources (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you may not access or use our Services.

2. About Thrive Tutors

Thrive Education Australia Pty Ltd (ACN 664 943 542), trading as Thrive Tutors, operates this platform to provide online tutoring services, educational resources and learning support focused on the Primary and Secondary curriculum, designed for students and their families.

3. Description of Services

3.1 Educational Services

We provide:

         One-on-one online tutoring sessions with qualified teachers and university tutors

         Educational blog content and articles

         Digital PDF downloads and online learning materials

3.2 Platform Features

Our platform includes:

         Access to educational resources and learning materials

         Lesson scheduling and management tools

         Customer support services

3.3 Service Changes and Availability

         We reserve the right to modify, suspend or discontinue any part of our Services, content or platform features at any time without prior notice

         We will not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Services

4. Intellectual Property Rights

4.1 Our Content

All content on our platform, including but not limited to:

         Text, graphics, logos, icons and images

         Software, code and digital materials

         Blog posts, articles and educational resources

         Audio, video and interactive elements

is owned by Thrive Education Australia Pty Ltd or our licensors and is protected by copyright, trademark and other intellectual property laws.

4.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable licence to:

         Access and use our content for personal educational purposes

         View and learn from our blog posts, videos and resources

4.3 Restrictions

You may not:

         Distribute, share or resell our content to third parties

         Modify, adapt or create derivative works

         Use content for commercial purposes

         Attempt to reverse engineer or extract source materials

         Remove copyright notices or proprietary markings

5. Prohibited Uses

You agree not to use our Services to:

5.1 Illegal Activities

         Violate any applicable laws or regulations

         Infringe on intellectual property rights

         Engage in fraudulent or deceptive practices

5.2 Harmful Conduct

         Harass, abuse or harm other users, tutors or staff

         Distribute malware, viruses or harmful code

         Attempt to gain unauthorised access to our systems

         Interfere with the proper functioning of our Services

5.3 Content Violations

         Upload or share inappropriate, offensive or illegal content

         Impersonate others or provide false information

         Violate the privacy rights of others

5.4 User Submissions and Feedback

         If you submit feedback, suggestions, ideas, reviews, comments or other materials ("Submissions") to us, you grant Thrive Education Australia Pty Ltd a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, adapt, publish, translate and distribute such Submissions in any medium

         You represent and warrant that your Submissions do not violate any third-party rights, including copyright, trademark, privacy or other personal or proprietary rights

         We have no obligation to (a) keep Submissions confidential, (b) compensate you for Submissions or (c) respond to Submissions

         We reserve the right, but are not obligated, to monitor, edit or remove Submissions that we determine in our sole discretion to be unlawful, offensive or otherwise objectionable

6. Billing and Payments

6.1 Payment Methods and Security

Thrive Tutors uses a transparent, automated billing system. Your credit or debit card details are stored on our secure payment platform. All lesson records, invoices and payment records are available through your Thrive Tutors account. All credit and debit card details are securely encrypted, kept confidential and deleted from our system once tutoring has ceased.

6.2 Lesson Billing

Lesson fees are billed weekly in advance of the booked lesson. Each payment covers one specific lesson that is scheduled to occur in 24 hours. By enrolling with Thrive Tutors, you authorise us to initiate a direct debit from your nominated payment method 24 hours before any lesson you with ThriveTutors is scheduled to occur.

6.3 Tutoring Tiers and Pricing

Thrive Tutors offers the following tutoring options:

Premium Tutoring $89 per lesson

1:1 online session delivered by a qualified, registered teacher. Ideal for students requiring structured curriculum support, exam preparation or in-depth conceptual guidance.

Standard Tutoring $59 per lesson

1:1 online session delivered by a high-achieving university tutor. Ideal for students seeking homework support, confidence building or general academic guidance.

When you join Thrive Tutors, a one-off $99 enrolment fee applies per child. This covers the onboarding process and getting everything set up so your child's first lesson hits the ground running. A separate fee applies for each child enrolled. 

6.4 Lesson Credits

Where a Client provides the required cancellation notice (see Clause 7 Cancellations), a lesson credit will be applied to the Client's account. Lesson credits:

         Roll over month to month and expire on 31 December each year and will not carry over to the following year

         Have no monetary value and cannot be refunded or exchanged for cash

6.6 Switching Tutoring Tiers

You may request to switch between Premium Tutoring and Standard Tutoring at any time by contacting us at hello@thrivetutors.com.au. Changes will take effect at the time of your next lesson.

7. Weekly Tutoring, Cancellations and Rescheduling

7.1 Commitment to Weekly Tutoring

Thrive Tutors is committed to providing consistent, ongoing support for every student. We take on students who are seeking regular weekly tutoring and while occasional cancellations and rescheduling are understood, students who demonstrate a consistent lack of commitment may have their enrolment reviewed so that we can offer their spot to students on our waiting list.

7.2 Cancellation and Rescheduling Policy

To cancel or reschedule a session, Clients must cancel their lesson at least 24 hours prior to the Scheduled Booking through the Thrive Tutors platform. If 24 hours' notice is provided, you will not be required to pay for the cancelled lesson. If less than 24 hours' notice is given, or no notice is provided, the full session fee will be charged, and no credit will be applied.

7.3 Failure to Attend

If a Student fails to attend a Scheduled Booking without prior notice, the full session fee will be charged. Repeated no-shows may result in a review of the Student's enrolment.

8. Termination of Tutoring

8.1 No Lock-In Contracts

Thrive Tutors does not have lock-in contracts. If you are not satisfied with your tutoring experience, you may cease tutoring at any time in accordance with our cancellation policy. If you would like to request a change of tutor for any reason, please contact us at hello@thrivetutors.com.au.

8.2 Termination by You

         You may terminate your tutoring enrolment at any time by providing a minimum of two (2) weeks' written notice via email to hello@thrivetutors.com.au

         Failure to provide two weeks' notice will result in a $100 termination charge

         Termination does not entitle you to a refund for the current month's prepaid lessons. Any unused lesson credits at the time of termination will expire immediately upon termination.

8.3 Termination by Us

We may terminate or suspend your tutoring services if you:

         Violate these Terms or our policies

         Demonstrate a consistent lack of commitment to weekly tutoring

         Fail to pay required fees

         Engage in inappropriate, harmful or disrespectful behaviour toward tutors or staff

9. Refunds for Tutoring

9.1 Cancelling or Rescheduling a Single Lesson

To cancel an upcoming lesson, please cancel at least 24 hours in advance via hello@thrivetutors.com.au or through the Thrive Tutors platform. Where valid notice is provided, a lesson credit will be applied to your account. No monetary refund will be issued for individual cancelled lessons.

9.2 Terminating Tutoring Permanently

To terminate tutoring permanently:

         Notify Thrive Tutors by emailing hello@thrivetutors.com.au with a minimum of two (2) weeks' written notice

         Cancel any upcoming Scheduled Bookings through the platform or by contacting your tutor directly with at least 24 hours' notice

9.3 Enrolment Fee

The one-off Enrolment Fee of $100 is non-refundable under all circumstances.

10. Content Accuracy and Disclaimers

10.1 Educational Content Disclaimer

         Our tutoring and educational content is designed to supplement, not replace, formal education

         We strive for accuracy but cannot guarantee that all content is error-free

         Educational outcomes may vary based on individual effort and circumstances

         We are not affiliated with or endorsed by any curriculum and assessment authority

10.2 Curriculum Authority Disclaimer

Thrive Tutors is not affiliated with, nor endorsed by, any state or territory Curriculum and Assessment Authority. These authorities provide the only official, up-to-date versions of publications, study designs and information about senior secondary certificates of education. All curriculum names, course titles and examination materials remain the property of their respective authorities.

10.3 Third-Party Content

         We may include links to third-party websites or resources

         We do not endorse or take responsibility for third-party content

         Your use of third-party services is subject to their own terms and conditions

10.4 Website Information Disclaimer

         Information made available on our website, blog, videos or other resources may not always be accurate, complete or up to date

         Such information is provided for general educational and informational purposes only and should not be relied upon as the sole basis for making decisions

         We do not undertake an obligation to update any information except as required by law

10.5 Third-Party Tools

         We may provide you with access to optional third-party tools or integrations over which we have no control or input

         You acknowledge and agree that such tools are provided "as is" and "as available" without warranties of any kind

         Your use of optional third-party tools offered through our Services is entirely at your own risk and discretion and may be subject to the third-party provider's own terms

         We are not liable for any loss or damage arising from your use of third-party tools or integrations

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use and protect your personal information. By using our Services, you consent to the collection and use of information as outlined in our Privacy Policy. Our Privacy Policy is available on our website.

12. Limitation of Liability

To the maximum extent permitted by law:

12.1 Disclaimer of Warranties

         Our Services are provided "as is" without warranties of any kind

         We disclaim all warranties, whether express, implied or statutory

         We do not warrant that our Services will be uninterrupted or error-free

12.2 Limitation of Damages

         Our liability is limited to the amount you paid for the specific service in the three months preceding the relevant claim

         We are not liable for indirect, incidental or consequential damages

         This includes lost profits, data loss or educational opportunities

13. Indemnification

You agree to indemnify and hold harmless Thrive Education Australia Pty Ltd, its officers, directors, employees and agents from any claims, losses, damages or expenses arising from:

         Your violation of these Terms

         Your misuse of our Services

         Your violation of any third-party rights

         Any content you submit or share through our platform

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

         We will update the "Last Updated" date at the top of this document

         We will notify you through our website or via email

         Continued use of our Services constitutes acceptance of the updated Terms

         Material changes may require your explicit consent

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of our Services will be subject to the exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from those courts.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and Thrive Education Australia Pty Ltd regarding your use of our Services.

19. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, term or condition, right or remedy implied or imposed by the Competition and Consumer Act 2010 (Cth) or any other applicable Australian consumer protection law that cannot lawfully be excluded, restricted or modified.
